(a)   Every residence or improved lot within the City of Linn Valley, Kansas shall have on it prominently display, within 8 feet of the road or street right of way, a correct 911-compliant street number for the home or business. Said numbers shall consist of a reflective sign with reflective numbers at least three inches in height and shall be positioned in such a manner as to be readily visible to emergency responders and others from the street.

(b)   Violation of section (a) shall be deemed a misdemeanor punishable, upon conviction, by a fine of $30.00.

(c)   Correction of said violation, as verified by written certification by the City Police Department or Codes Officer, prior to the defendant’s arraignment date, shall result in the charge being dismissed at the City’s cost.

(d)   Upon conviction, said fine shall be suspended upon certification by the City Police Department or Codes Officer in writing that the property owner has corrected the said failure to comply within 10 days of conviction and payment of court costs, if so ordered by the court.

(a)   Definitions.

(1)   Bulkhead/Sea Wall means a revetment or retaining wall sunk into hard ground and designed to prevent slippage or water erosion of the shoreline.

(2)   Dock means a structure, usually supported by piles, extending over the water and equipped for mooring boats.

(3)   Ramp or Boat Ramp means a paved inclined passageway extending from dry land into the water so as to provide for safe launching and removal of boats into or from the water.

(4)   Structural alterations mean any change, except for repair or replacement, in the supporting members of a building or other structure.

(5)   Common Property means property owned by the Linn Valley Lakes Property Owners Association (“POA”) or over which said POA has control through easements or other agreements.

(b)   Prohibition. No bulkhead, sea wall, dock, boat ramp or other similar structure shall be constructed, nor shall structural alterations be made to such, nor shall any dredging of or within waterways be undertaken, either on private property or on common property without an approved permit issued by the city building official in accordance with the Ordinances of the City and with Regulations and Policies.

(c)   No permit to build or make structural alterations to a bulkhead, sea wall, dock, boat ramp or other similar structure on common property shall be granted unless the Board of Directors of the POA or its designee shall have granted its approval of the application for such permit in writing.
