Article 1. City Planning Commission/Board of Zoning Appeals

Members shall be appointed for three year terms, to begin on May l of each year with no more than 2 members’ terms expiring in any given year.

The Planning commission herein established shall meet at such time and place as may be fixed in the commission’s bylaws. Special meetings of the planning commission may be called by the chairperson or in his absence, the vice chairperson. A quorum of the planning commission is by a majority of the commissioners. Records shall be kept of all commission proceedings.

The commission shall organize itself annually and select from its members a chairperson and vice chairperson who are each selected for a one (1) year term. A secretary shall be selected, but he or she may be some person who is not a member of the commission. The commission shall have such employees and consultants as the commission requires.

The planning commission shall prepare and submit to the governing body on or before the first Monday of July of each year an itemization of its expenses, amounts and purpose. The Governing Body may consider and make such allowance as it may deem proper. The Governing Body may enter into any necessary contracts, receive and expend funds from state and federal governments or any other sources as may be authorized.

Each member of the planning commission shall subscribe to an oath before entering upon his or her duties as a member of said planning commission.

The planning commission is hereby designated to also serve as the city’s board of zoning appeals with all the powers and duties as provided for in K.S.A. 12-759.

(a)   The planning commission may adopt a comprehensive plan and request of the governing body of the city such additional enactments or ordinances as may be necessary.

(b)   The governing body of the city has approved the City of Linn Valley 2007 Comprehensive Plan pursuant to the provisions set forth in K.S.A. 12-747.

(c)   Said comprehensive plan has subsequently been amended by Ordinance No. 119.

The Governing Body has heretofore adopted the “Interlocal Agreement Between Miami County, Kansas and the City of Linn Valley, Kansas Providing for the Planning of the Use and Development of Land Within Unincorporated Territory Designated as the Urban Growth Areas of the City of Linn Valley, Kansas.” Such Agreement is hereby incorporated by reference, as provided by K.S.A. 12-3301 et seq., and shall be as much a part of this section as if set out fully herein.
