A CHARTER ORDINANCE EXEMPTING THE CITY OF LINN VALLEY, KANSAS, FROM K.S.A. 15-209, INSOFAR AS SAID STATUTE APPLIES TO THE APPOINTED OFFICERS OF THE CITY AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT RELATING TO THE APPOINTMENT OF CITY OFFICERS AND AMENDING ORDINANCE NO. 11.

IT IS HEARBY ORDAINED BY THE GOVERNING BODY OF THE CITY OF LINN VALLEY, KANSAS:

Section 1. The City of Linn Valley, Kansas, a City of the Third Class, by the power vested in it by Article 12, Section 5 of the Constitution of the State of the State of Kansas, hereby elects to exempt itself from the provisions of K.S.A. 15-209 insofar as said section applies to the residency of appointed city officers.

Section 2. Charter Ordinance No. 11 is hereby amended as follows:

       “D. Qualifications and Filling Vacancies. Appointed officers of the City of Linn Valley, Kansas, need not be qualified electors of said city and may reside outside of said area of said city.

Section 3. Except as herein specifically provided, other provisions of K.S.A. 15-209 not pertaining to the residence of appointed city officers shall apply in all respects to the City of Linn Valley, Kansas.
