(a)   A fee set by resolution is to be paid by each customer and high volume customer of the public sewer system. The two types of customers are:

(1)   Residential customers -  billed at a flat rate.

(2)   High volume users - Billing for High Volume Customers will be based on total volume of wastewater flowing into the City of Linn Valley wastewater treatment facility (lagoons). Wastewater system volume will be calculated on volume as measured by City-installed wastewater flow meters. High Volume Customers will be billed monthly at the City’s established billing rate based on metered volume of wastewater.

(b)   Late fees, penalties, and other costs will be set by resolution and are hereby authorized to be assessed against any customer whose bill is not paid by the designated due date.

The owner of premises served, and the user of the public sewer system shall be jointly and severally liable for the cost of the sewer service provided on said premises.

All charges levied shall constitute a lien upon the premises served, and if not paid within sixty days after due date, charges shall be certified to the County Clerk and County Treasurer and shall be collectible in the same manner as taxes.

All revenues and moneys derived from the operation of the public sewer system shall be held by the City in funds and accounts that are separate from other city funds and which are designated the “Sanitary Sewer Fund”. The governing body and its agents shall administer said fund in the manner provided by the Statutes of Kansas and all other laws pertaining thereto.

The city shall establish a system of accounts and records to manage the Sanitary Sewer Fund according to statute and shall cause said records to be included in the annual audit of the city’s finances.
